Estas condiciones regulan el acceso y uso de la plataforma digital de Yummy, su página web, productos y servicios, e incluyen nuestra Política de Privacidad y Seguridad.
These terms govern access to and use of the Yummy digital platform, its website, products and services, and include our Privacy and Security Policy.
LEA DETENIDAMENTE LOS SIGUIENTES TÉRMINOS Y CONDICIONES ANTES DE ACCEDER O UTILIZAR LOS SERVICIOS, CON EL PROPÓSITO DE ASEGURARSE DE QUE USTED ENTIENDE CADA DISPOSICIÓN.
El presente documento de Términos y Condiciones de uso (en adelante “Términos y Condiciones”), regulan el acceso y uso de los Usuarios (en adelante “Usuarios”), como persona natural o jurídica, de la plataforma digital de Yummy, página web, productos y servicios (en adelante “Servicios”).
Mediante su acceso o uso de los Servicios el Usuario acepta expresa e irrevocablemente los Términos y Condiciones acá descritos y acuerda obligarse al cumplimiento de los presentes, los cuales regulan la relación entre el Usuario y Yummy. Si el Usuario no aceptare los presentes Términos y Condiciones, deberá abstenerse de usar los Servicios. Yummy podrá poner fin de manera inmediata a estos Términos y Condiciones o cualquiera de los Servicios respecto de usted o, en general, dejar de ofrecer o denegar el acceso o uso de los Servicios de manera total o parcial, en cualquier momento y por cualquier motivo. Yummy podrá modificar los presentes Términos y Condiciones relativos a los Servicios cuando lo considere conveniente, ya sea realizando su publicación por medio del portal web o con simple aviso por cualquier otro medio que considere pertinente a los Usuarios. Las modificaciones serán efectivas después de la comunicación por parte de Yummy, bajo cualquier modalidad, de los Términos y Condiciones actualizados sobre el Servicio aplicable. Su posterior acceso o uso continuado de los Servicios después de dicha comunicación constituye su consentimiento tácito y vinculante hacia los presentes Términos y Condiciones y sus modificaciones. La recopilación y el uso que hacemos de su información personal en relación con los Servicios será tratada conforme a las políticas de privacidad de Yummy, las cuales pueden ser consultadas a través del portal web o la aplicación.
Se refiere a la sociedad mercantil intermediaria domiciliada en el territorio donde fueron solicitados los Servicios.
Se refiere a la persona natural que adquiere productos y/o Servicios a través de la plataforma digital.
Se refiere a la persona natural que presta el servicio de operador independiente de transporte, encargado de realizar el transporte de los bienes adquiridos a través de la plataforma digital.
Se refiere al pedido realizado por el Usuario, el cual contiene toda la información respectiva a los bienes y/o Servicios adquiridos, su pago, dirección de envío, entre otros.
Se refiere a la persona natural o jurídica que ofrece bienes y/o servicios a través de la plataforma digital.
Los Servicios constituyen una plataforma de tecnología que permite a los Usuarios de aplicación móvil de Yummy ordenar la entrega a domicilio de servicios o bienes tales como comida, bebidas, medicamentos, productos terminados así como, artículos de venta en supermercado, tiendas de conveniencia, tickets o entradas para asistir a eventos y/o cualquier otro producto lícito proveídos por Comercios que se encuentren afiliados a la plataforma Yummy, siempre que no vaya en contravención con las legislaciones nacionales y pueda incluirse dentro de los backpacks que portan los Terceros Proveedores.
El Usuario reconoce que Yummy solamente es una plataforma tecnológica que funciona como intermediario, y que no presta servicios de transporte o de logística, por ende no funciona como una empresa de transporte, y que dichos servicios de transporte o logística se prestan por terceros operadores independientes de transporte (en adelante “Tercero Proveedor”), que no están empleados por Yummy y que son los responsables del cumplimiento de cualquier requerimiento legal o permiso para poder operar y proveer el servicio, así como cumplir con toda la legislación nacional aplicable.
Sujeta al cumplimiento de estos Términos y Condiciones, Yummy le otorga una licencia limitada, no exclusiva, no sublicenciable, revocable, y no transferible para: (i) el acceso y uso de las Aplicaciones en su dispositivo personal solo en relación con su uso de los Servicios; y (ii) el acceso y uso de cualquier contenido, información y material relacionado que pueda ponerse a disposición a través de los Servicios; en cada caso será solo para su uso personal, no comercial. Yummy y sus Licenciantes se reservan cualquier derecho que no haya sido expresamente otorgado por el presente.
El Usuario no podrá: (i) reproducir, modificar, preparar obras derivadas sobre los Servicios, distribuir, licenciar, arrendar, revender, transferir, exhibir públicamente, presentar públicamente, transmitir, retransmitir o explotar de otra forma los Servicios, excepto cuando esto sea permitido expresamente por Yummy; (ii) enlazar, reflejar o enmarcar cualquier parte de los Servicios; (iii) causar o lanzar cualquier programa o script con el objeto de extraer, indexar, analizar o de otro modo realizar prospección de datos de cualquier parte de los Servicios o sobrecargar o bloquear indebidamente la operación y/o funcionalidad de cualquier aspecto de los Servicios; o (iv) intentar obtener un acceso no autorizado o dañar cualquier aspecto de los Servicios o sus sistemas o redes relacionados. Los Servicios y todos los derechos relativos a estos son y permanecerán como propiedad de Yummy o de sus Licenciantes, en las formas y tiempos en los que Yummy determine, por lo que con el otorgamiento de estas licencias no se transfiere propiedad sobre ningún derecho, excepto sobre aquellos que se desprendan del uso adecuado de la plataforma digital.
Con el fin de usar la mayor parte de los aspectos de los Servicios, el Usuario debe registrarse y mantener activa una cuenta personal de Usuario de los Servicios (“Cuenta”). Para obtener una Cuenta debe tener como mínimo dieciocho (18) años de edad. El registro de la Cuenta le requiere que comunique a Yummy determinada información personal, como el nombre y apellido, dirección, número de identificación personal y/o tributaria, número de teléfono móvil. El Usuario se compromete a mantener la información en su Cuenta de forma exacta, completa y actualizada, en su defecto, si no mantiene la información de Cuenta de forma exacta, completa y actualizada, podrá resultar en su imposibilidad para acceder y utilizar los Servicios o en la terminación de la misma por parte de Yummy. El Usuario es responsable de toda la actividad que ocurre en su Cuenta y se compromete a mantener en todo momento de forma segura y secreta el nombre de Usuario y la contraseña de su Cuenta. A menos que Yummy permita otra cosa por escrito, el Usuario solo puede poseer una Cuenta. Yummy se reserva el derecho de poner a disposición diferentes tipos de Cuentas para distintos tipos de Usuarios y podrá, a su sola discreción y sin justificación, crear, mantener, administrar y eliminar Cuentas. La Cuenta le da acceso al Usuario para el uso de los Servicios y funcionalidades que podemos crear y mantener de tiempo en tiempo bajo la sola discreción de Yummy.
El Servicio no está disponible para el uso de personas menores de dieciocho (18) años. El Usuario no podrá autorizar a terceros a utilizar su Cuenta, asimismo no podrá permitir a personas menores de dieciocho (18) años que reciban los Servicios ni bienes o servicios brindados a través de los mismos. No podrá ceder o transferir de otro modo su Cuenta a cualquier otra persona o entidad. Este acuerda cumplir con todas las leyes aplicables al utilizar los Servicios y solo podrá utilizar los Servicios con fines lícitos (p. ej., no podrá ser utilizada para el transporte de bienes o sustancias ilícitas o peligrosas). En algunos casos, Yummy podrá denegar el uso de los Servicios si en el cumplimiento de los mismos ello pudiese significar un riesgo para los Terceros Proveedores (p. ej., el ingreso a zonas con presencia de grupos delictivos y/o terroristas, zonas que por sus características y edificaciones aledañas sean declaradas como de seguridad por organismos del Estado, lo cual limita el acceso a las mismas; entre otras razones). Asimismo, Yummy podrá requerir la presentación de su documento de identidad para el acceso, uso o entrega de los Servicios, y en caso declinar su presentación, podrá negarse el acceso, uso o entrega de los Servicios. Del mismo modo, los Terceros Proveedores podrán requerir la validación de su identidad para hacer entrega de la Orden.
Al crear una Cuenta, el Usuario acepta que Yummy, a través de la prestación de Servicios de un tercero o por sus propios medios, le pueda enviar comunicaciones a través de los siguientes medios de comunicación: mensajes de texto, ventanas emergentes, notificaciones push o de inserción, correos electrónicos u otros, como parte del ejercicio de la actividad comercial normal y el uso de los Servicios. El Usuario podrá solicitar la no recepción de estas comunicaciones informativas o promocionales de Yummy en cualquier momento y reconoce que solicitar la no recepción de los mismos, podrá afectar el uso que haga de los Servicios.
Yummy podrá, a su sola discreción: (i) crear códigos promocionales o de descuento, (ii) otorgar cupones de compensación extraordinarios para sus otras verticales o aplicaciones, (iii) otorgar premios por iniciativas de marca, que podrán ser aprovechados según los parámetros establecidos en su única Cuenta u otros elementos o beneficios relacionados con los Servicios y/o los servicios de un Tercero Proveedor, con sujeción a cualquier condición adicional que Yummy establezca sobre la base de cada código promocional (en adelante “Códigos Promocionales”).
Uso debido de los Códigos Promocionales: (i) deben usarse por el Usuario según los parámetros establecidos y para el propósito deseado de manera lícita; (ii) no podrán duplicarse, venderse o transferirse de ninguna manera, o ponerse a disposición del público general (tanto si se publican en un foro público como de otra forma), a menos que sea previamente notificado y aprobado por Yummy; (iii) podrán ser invalidados por Yummy en cualquier momento por cualquier motivo sin responsabilidad para Yummy; (iv) no son válidos como efectivo; (v) podrán caducar o alcanzar el límite de usos antes de que sean utilizados, en el entendido que si los mismos no se utilizan dentro de los diez (10) días hábiles siguientes los mismos podrán cancelarse o perder su vigencia. Cualquier tipo de actuar por parte del Usuario en contravención con lo establecido anteriormente, facultará de pleno derecho a Yummy de terminar de forma temporal o permanente su cuenta, cuando este lo considere necesario.
Yummy se reserva el derecho de retener o deducir el crédito u otros elementos o beneficios obtenidos a través de la utilización de los Códigos Promocionales por el Usuario en el caso de que Yummy determine o considere que el uso o el canje de los Códigos promocionales fue de modo erróneo, fraudulento, ilegal o infringiendo las condiciones del Código promocional o las presentes Condiciones. Yummy se reserva el derecho de tomar las acciones legales que considere pertinentes si se llegaren a verificar los supuestos anteriores.
Yummy podrá, a su sola discreción permitir al Usuario, cuando considere oportuno, que envíe, cargue, publique o de otro modo ponga a disposición de Yummy a través de los Servicios, contenido e información de texto, audio y/o visual, incluidos comentarios y opiniones relativos a los Servicios, iniciación de peticiones de apoyo, así como presentación de admisiones para competiciones y promociones (en adelante “Contenido de Usuario”). Todo Contenido de Usuario facilitado por el Usuario seguirá siendo de su propiedad. No obstante, al proporcionar Contenido de Usuario a Yummy, usted otorga una licencia mundial, perpetua, irrevocable, transferible, libre de regalías, con derecho a sublicenciar, usar, copiar, modificar, crear obras derivadas, distribuir, exhibir públicamente, presentar públicamente o de otro modo explotar de cualquier manera dicho Contenido de Usuario en todos los formatos y canales de distribución, conocidos ahora o ideados en un futuro (incluidos en relación con los Servicios y el negocio de Yummy y en sitios y servicios de terceros), sin más aviso o consentimiento y sin requerirse el pago al Usuario o a cualquier otra persona o entidad.
El Usuario declara y garantiza que: (i) es el único y exclusivo propietario de todo el Contenido de Usuario o que tiene todos los derechos, licencias, consentimientos y permisos necesarios para otorgar a Yummy la licencia al Contenido de Usuario como establecido anteriormente; y (ii) ni el Contenido de Usuario ni su presentación, carga, publicación o puesta a disposición de otro modo de dicho Contenido de Usuario, ni el uso por parte de Yummy del Contenido de Usuario como está aquí permitido, infringirán, malversarán o violarán la propiedad intelectual o los derechos de propiedad de un tercero o los derechos de publicidad o privacidad o resultarán en la violación de cualquier ley o reglamento aplicable. El Usuario acuerda no proporcionar Contenido de Usuario que sea difamatorio, calumnioso, odioso, violento, obsceno, pornográfico, ilícito o de otro modo ofensivo, de conformidad con la legislación aplicable o como determine Yummy conforme a sus valores y su sola discreción, tanto si dicho material pueda estar protegido o no por la Ley. Yummy podrá, a su sola discreción y en cualquier momento y por cualquier motivo, sin previo aviso, revisar, controlar o eliminar Contenido de Usuario, pero sin estar obligado a ello.
El Usuario es responsable de obtener el acceso a la red de datos necesario para utilizar los Servicios. Podrán aplicarse las tarifas y tasas de datos y mensajes de su red móvil si este accede o utiliza los Servicios desde un dispositivo móvil y el Usuario será responsable de dichas tarifas y tasas. Es responsable de adquirir y actualizar el hardware compatible o los dispositivos necesarios para acceder y utilizar los Servicios y Aplicaciones y cualquier actualización de estos. Yummy no garantiza que los Servicios, o cualquier parte de estos, funcionen en cualquier hardware o dispositivo particular. Además, los Servicios podrán ser objeto de disfunciones o retrasos inherentes al uso de Internet, su velocidad de carga y/o descarga, su conexión, estabilidad y de las comunicaciones electrónicas, liberando de esta forma a Yummy sobre cualquier daño que bajo estas circunstancias pueda sufrir el Usuario.
Sin perjuicio de lo dispuesto en la Política de Privacidad de Yummy, este podrá recolectar y procesar información personal con el objetivo de conectar Usuarios con Terceros Proveedores de Servicios, enlazar información geográfica, y poner a disposición el número de teléfono de los Usuarios con los Terceros Proveedores para un eficiente Servicio. La recolección de información geográfica se detendrá después de cerrar la plataforma tecnológica o de haber recibido la Orden y/o Servicio. Yummy podrá utilizar información de ubicación geográfica para resolver problemas de calidad relacionados con los Servicios. Yummy podrá recolectar información de las rutas tomadas por los Terceros Proveedores y Usuarios para analizar la cobertura geográfica en orden de proveer recomendaciones a los Terceros Proveedores sobre rutas de entrega más eficientes. La información personal del Usuario será únicamente revelada al Tercero Proveedor que ha aceptado brindar dicho servicio, la cual podrá ser el nombre de Usuario, fotografía, ubicación geográfica del mismo y del lugar de entrega, número de teléfono, entre otros necesarios para la prestación del Servicio. El nombre y número de teléfono del Usuario permanecerá visible al Tercero Proveedor hasta terminar o completar el Servicio.
El Usuario entiende que el uso de los Servicios puede derivar en cargos por los Servicios o bienes que reciba de Yummy o de un Tercero proveedor (en adelante “Cargos”). Antes o después de que haya recibido los Servicios u obtenido los bienes mediante el uso de los Servicios, Yummy facilitará el pago de los Cargos aplicables en nombre del Tercero Proveedor como agente de cobro limitado del Tercero Proveedor. El pago de los Cargos de dicha manera se considerará como el pago efectuado directamente por el Usuario al Tercero Proveedor. Los Cargos incluirán los impuestos aplicables cuando se requiera por Ley. Los Cargos pagados por el Usuario son definitivos y no reembolsables, según lo establecido en las Políticas de Reembolsos y Devoluciones de Yummy.
Todos los Cargos son pagaderos inmediatamente y el pago se facilitará por Yummy utilizando el método de pago preferido indicado en su Cuenta, y después de ello Yummy le enviará un recibo por correo electrónico. Si se determina que el método de pago de su Cuenta ha caducado, es inválido o de otro modo no sirve para cobrarle, el Usuario acepta que Yummy, como agente de cobro limitado del Tercero Proveedor, debite montos disponibles en su Cuenta, si estuvieran disponibles.
Si por algún motivo o circunstancia el Usuario cancela su pedido, en el caso que dicha causa no fuera atribuible a Yummy, autoriza sin prejuicio alguno a que Yummy le retenga en su tarjeta de débito o crédito la cantidad de la transacción por un periodo de treinta (30) días, y Yummy pondrá a disposición del Usuario a solicitarlo nuevamente únicamente en ese mismo periodo, pero siempre y cuando la Orden no haya ingresado en la etapa de preparación o elaboración por el Comercio afiliado o haya sido despachada, los cuales no serán reembolsables. Asimismo, el Servicio solicitado a través de Yummy y a ser prestado por un Tercero Proveedor, se entenderá aceptado cuando este Tercero Proveedor acepta dicha orden de Servicio; es decir, una vez que el Tercero Proveedor confirme que esta persona prestará dicho Servicio. Por lo tanto, se considerará cancelada una Orden de servicio cuando el Tercero Proveedor haya contestado la petición y el Usuario inmediatamente rechace o cancele dicho Servicio. Cuando un Servicio solicitado a través de Yummy y a ser prestado por un Tercero Proveedor es cancelado después de tres (3) minutos, Yummy se reserva el derecho de cobrar una tasa de cancelación total o parcial del Cargo.
En caso de que el Tercero Proveedor no pueda entregar la Orden o ejecutar los Servicios por razones de fuerza mayor, causa extraña no imputable, razones meteorológicas, Yummy no será responsable de dichas circunstancias. Cuando el Tercero Proveedor notifique al Usuario la llegada del Servicio solicitado y el Usuario solicitante de dicho Servicio no se encuentra en el lugar indicado en su Cuenta, el Servicio se entenderá como cancelado y el Usuario asumirá el costo. Además, el Usuario reconoce y acepta que los Cargos aplicables en determinadas zonas geográficas podrán incrementar sustancialmente dependiendo de la distancia de estas zonas geográficas. Sin embargo, el Usuario no tiene derecho a ningún reembolso por cancelación una vez el Comercio o Tercero Proveedor haya aceptado la orden y se encuentre en preparación o elaboración. Asimismo, el Usuario entiende y acepta que los códigos de compensación regulares o extraordinarios que otorgue, tendrán una duración máxima de diez (10) días hábiles.
En el caso que Yummy suspenda o cancele la cuenta de un Usuario por comportamiento o actividades que pudieran ser irregulares, se den por terminados los presentes Términos y Condiciones, o cambie la propiedad de Yummy, el Usuario entiende y acepta que no recibirá ningún reembolso o indemnización por ello, o por cualquier contenido o datos asociados con su Cuenta, o para cualquier otra cosa, excepto si Yummy está de acuerdo con ello bajo su sola discreción. Esta estructura de pago está destinada para compensar plenamente al Tercero Proveedor por los Servicios. El Usuario entiende y acepta que, mientras es libre de proporcionar un pago adicional como gratificación a cualquier Tercero Proveedor que le proporcione Servicios, no tiene obligación de ello, ya que las gratificaciones al Tercero Proveedor, son voluntarias. Después de que haya recibido o completado los Servicios, tendrá la oportunidad de calificar su experiencia y dejar comentarios adicionales sobre Yummy y el Tercero Proveedor.
El Usuario libera de todo tipo de responsabilidad a Yummy sobre los pedidos que éste haya recibido y aceptado con el precinto de seguridad y garantía roto o abierto, en el entendido que este no podrá formular reclamos en contra de Yummy bajo ningún concepto, ya que se encuentra en la obligación de negarse a recibir la entrega de los pedidos cuyo precinto de seguridad y garantía presente irregularidades o del cual se pueda evidenciar que ha sido roto, pudiendo cualquier tercero acceder o manipular los contenidos del pedido.
El Usuario declara que no procederá a realizar la disputa de pagos realizados a Yummy sobre Órdenes efectivamente recibidas y/o Servicios prestados, o sobre aquellos que procedan o no reembolsos bajo cualquier circunstancia. Este deberá proceder con reportar las incidencias presentadas a través del canal de atención al cliente dentro de la plataforma digital donde el equipo de Yummy evaluará el caso y determinará la procedencia del reembolso, al igual que el porcentaje del monto pagado que este represente de acuerdo a lo establecido en la cláusula anterior.
RENUNCIA: YUMMY RENUNCIA A TODA DECLARACIÓN Y GARANTÍA, EXPRESA, IMPLÍCITA O ESTATUTARIA, NO EXPRESAMENTE ESTABLECIDA EN ESTOS TÉRMINOS Y CONDICIONES, INCLUIDAS LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN PARTICULAR Y NO VIOLACIÓN. ADEMÁS, YUMMY NO HACE DECLARACIÓN NI PRESTA GARANTÍA ALGUNA RELATIVA A LA FIABILIDAD, PUNTUALIDAD, CALIDAD, IDONEIDAD O DISPONIBILIDAD DE LOS SERVICIOS O CUALQUIERA DE LOS SERVICIOS O BIENES SOLICITADOS A TRAVÉS DEL USO DE LOS SERVICIOS, O QUE LOS SERVICIOS NO SERÁN INTERRUMPIDOS O ESTARÁN LIBRES DE ERRORES. YUMMY NO GARANTIZA LA CALIDAD, IDONEIDAD, SEGURIDAD O HABILIDAD DE LOS TERCEROS PROVEEDORES. USTED ACUERDA QUE TODO RIESGO DERIVADO DE SU USO DE LOS SERVICIOS O BIEN SOLICITADO EN RELACIÓN CON AQUELLOS SERÁ ÚNICAMENTE SUYO, EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE.
LIMITACIÓN DE RESPONSABILIDAD: YUMMY NO SERÁ RESPONSABLE DE DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, EJEMPLARES, PUNITIVOS O EMERGENTES, INCLUIDOS EL LUCRO CESANTE, LA PÉRDIDA DE DATOS, LA LESIÓN PERSONAL O EL DAÑO A LA PROPIEDAD, NI DE PERJUICIOS RELATIVOS, O EN RELACIÓN CON, O DE OTRO MODO DERIVADOS DE CUALQUIER USO DE LOS SERVICIOS, INCLUSO AUNQUE YUMMY HAYA SIDO ADVERTIDO DE LA POSIBILIDAD DE DICHOS DAÑOS. YUMMY NO SERÁ RESPONSABLE DE CUALQUIER DAÑO, RESPONSABILIDAD O PÉRDIDA QUE DERIVEN DE: (I) SU USO O DEPENDENCIA DE LOS SERVICIOS O SU INCAPACIDAD PARA ACCEDER O UTILIZAR LOS SERVICIOS; O (II) CUALQUIER TRANSACCIÓN O RELACIÓN ENTRE USTED Y CUALQUIER TERCERO PROVEEDOR, AUNQUE YUMMY HUBIERA SIDO ADVERTIDO DE LA POSIBILIDAD DE DICHOS DAÑOS. YUMMY NO SERÁ RESPONSABLE DEL RETRASO O DE LA FALTA DE EJECUCIÓN RESULTANTE DE CAUSAS QUE VAYAN MÁS ALLÁ DEL CONTROL RAZONABLE DE YUMMY. LAS LIMITACIONES Y LA RENUNCIA EN ESTE APARTADO NO PRETENDEN LIMITAR LA RESPONSABILIDAD O ALTERAR SUS DERECHOS COMO CONSUMIDOR QUE NO PUEDAN EXCLUIRSE SEGÚN LA LEY APLICABLE.
Indemnidad: Usted acuerda mantener indemnes y responder frente a Yummy y sus consejeros, directivos, empleados y agentes por cualquier reclamación, demanda, pérdida, responsabilidad y gasto (incluidos los honorarios de abogados) que deriven de: (i) su uso de los Servicios o servicios o bienes obtenidos a través del uso de los Servicios; (ii) su incumplimiento o violación de cualquiera de estos Términos y Condiciones; (iii) el uso por parte de Yummy de su Contenido de Usuario; o (iv) su infracción de los derechos de cualquier tercero, incluidos Terceros Proveedores.
Cualquier controversia que guarde relación directa o indirecta con este contrato entre el Usuario y Yummy, será resuelta mediante arbitraje de derecho de conformidad con las leyes del país donde hayan sido solicitados los servicios a través de la plataforma de Yummy, en la ciudad capital del país, en idioma español, por un árbitro de la jurisdicción arbitral al cual las partes declaran expresamente someterse.
Notificaciones: Yummy podrá notificar al Usuario por medio de una notificación general en los Servicios, mediante un correo electrónico enviado a su dirección electrónica estipulada en su Cuenta o por comunicación escrita enviada a su dirección, según lo dispuesto en su Cuenta. Usted podrá notificar a Yummy por comunicación escrita a la dirección de Yummy que aparece en la sección de “Contáctenos” del portal web de Yummy respectiva al territorio donde hayan sido solicitados los servicios. Si la notificación escrita es enviada a otra dirección, esta no será válida.
Disposiciones generales. El Usuario no podrá ceder ni transferir estos Términos y Condiciones, en todo o en parte, sin el consentimiento previo y por escrito de Yummy.
El Usuario da su aprobación a Yummy para ceder o transferir estos Términos y Condiciones, en todo o en parte, incluido a: (i) una subsidiaria o un afiliado; (ii) un adquirente del capital, del negocio o de los activos de Yummy; o (iii) un sucesor por fusión. No existe entre usted, Yummy o cualquier Tercero Proveedor una empresa conjunta o relación de socios, empleo o agencia como resultado del contrato entre el Usuario y Yummy o del uso de los Servicios.
Si cualquier disposición de estos Términos y Condiciones se considerara ilegal, nula o inexigible, ya sea en su totalidad o en parte, de conformidad con la legislación aplicable, dicha disposición o parte de ésta se considerará excluida de estos Términos y Condiciones, sin embargo, la legalidad, validez y exigibilidad del resto de las disposiciones de estos Términos y Condiciones no se verá afectada. En ese caso, las partes deberán reemplazar dicha disposición ilegal, nula o inexigible, en todo o en parte por una disposición legal, válida y exigible que tenga, en la medida de lo posible, un efecto similar al que tenía la disposición ilegal, nula o inexigible, dados los contenidos y el propósito de estos Términos y Condiciones.
Estos Términos y Condiciones constituyen el contrato íntegro y el entendimiento entre las partes en relación con el objeto y sustituye y reemplaza a todos los contratos o acuerdos anteriores o contemporáneos en relación con dicho objeto. En estos Términos y Condiciones, las palabras “incluido/a/os/as” e “incluye/n” significan “incluido, de forma meramente enunciativa”.
En el momento de la entrega del Producto, es responsabilidad del Usuario (o de la persona que reciba el Producto en su nombre) revisar que esté en óptimas condiciones, sin alteraciones de los precintos de seguridad y sin ningún defecto. El Usuario podrá formalizar el reclamo acerca de los Productos Perecederos (comida y bebida preparada) en un plazo no mayor a doce (12) horas y Productos no Perecederos en un plazo no mayor a veinticuatro (24) horas a contar desde su recepción.

Yummy no estará en la obligación de reintegrar ningún monto al Usuario en los siguientes supuestos:
Para tal efecto, el Usuario deberá formalizar su solicitud a través del Chat de Atención al Cliente, a través de la Aplicación, informando las razones del reclamo y anexando los soportes que evidencien el motivo de la solicitud. Yummy evaluará cada solicitud, con las razones indicadas, para validar si procede o no el reclamo y brindará respuesta al Usuario en un plazo no mayor a cinco (5) días hábiles contados desde la recepción del reclamo. Para la evaluación de la solicitud, Yummy podrá solicitar una descripción de la problemática, información relacionada a la orden, fotos del Producto correspondiente, videos, validación del pago y de la identidad del Usuario, y cualquier otro elemento relevante para el análisis del caso.
Para la formalización de las devoluciones de productos de Yummy Shop, el Usuario deberá contactar o dirigirse al Comercio, para solicitar el cambio directamente con ellos y la recomendación es que se haga habiendo cumplido con las siguientes condiciones: el Producto no debe haber sido utilizado, ni presentar desgaste o daño de ninguna naturaleza; el Producto deberá contar con el embalaje original; es decir, que el Producto deberá encontrarse en la misma forma como fue entregado al Usuario, incluyendo todas las etiquetas, manuales o empaques del Producto; y el Usuario deberá indicar el número de orden de la aplicación y presentar recibo de compra o comprobante de pago. En caso de orden de supermercado y farmacia el Usuario obtendrá únicamente la devolución del subtotal de la orden, sin incluir cargos por concepto de servicio de entrega y/o fee de servicio.
El reembolso del dinero o sustitución del producto no estará sujeto a costo alguno para el Usuario, cuando Yummy haya aceptado y revisado, que el reembolso o sustitución es procedente de acuerdo con sus criterios de verificación. El reintegro del dinero se realizará en consideración del método de pago que el Usuario utilizó inicialmente, y mediante abono a la cuenta bancaria que a tal efecto sea indicado por el Usuario. Los plazos para la realización de los reintegros pueden ser de entre dos (2) y quince (15) días hábiles contados desde la verificación por parte de Yummy sobre la procedencia del reclamo, Yummy no asumirá responsabilidad por los tiempos de ejecución de dichos reintegros que sean atribuibles a las distintas entidades financieras una vez se haya instruido el reintegro.
En los casos en que el Usuario seleccione como método de devolución “Saldo a Favor en su Perfil”, dispondrá de quince (15) días para realizar el uso del mismo y/o pedir el reembolso a su cuenta bancaria en dicho periodo. El Usuario podrá cancelar cualquier solicitud de servicio o producto en la aplicación, siempre que la orden no haya cambiado su estatus de “orden ingresada” a “orden en preparación”. En el caso que Comercio o Tercero Proveedor haya aceptado y comenzado a preparar la orden, el Usuario no tiene derecho a ningún reembolso o compensación por cancelación. En caso que Yummy suspenda o cancele su cuenta por sospecha de actividades irregulares o fraudulentas, o cambie la propiedad de Yummy, el Usuario entiende y acepta que NO recibirá ningún reembolso o indemnización por ello, o por cualquier contenido o datos asociados con su cuenta, o para cualquier otra cosa, excepto si habiendo realizado la verificación pertinente, Yummy está de acuerdo con ello bajo su sola discreción.
Por medio de esta Política de Privacidad y Seguridad, en YUMMY le informamos sobre los aspectos que usted debe saber y autorizar con relación a la privacidad de sus datos en este SITIO WEB y/o APP que se instala en dispositivos móviles o tabletas. Le informamos que contamos con una base de datos en la cual recopilamos, procesamos y almacenamos su INFORMACIÓN PERSONAL y con los fines establecidos a continuación.
La aplicación para dispositivos que incluye, pero no se limita, a los sistemas operativos IOS y Android, propiedad de YUMMY que se encuentra a disposición de los USUARIOS.
Significa el acaecimiento de un hecho o circunstancia (“Caso de Fuerza Mayor”) que imposibilita o impide que una parte cumpla una o más de sus obligaciones contractuales de acuerdo con el contrato, en la medida en que la parte afectada por el impedimento pruebe: (a) que dicho impedimento está fuera de su control razonable; y (b) que los efectos del impedimento no podrían razonablemente haber sido evitados o superados por la Parte Afectada.
Se refiere a toda aquella sociedad constituida de conformidad con las leyes del territorio donde se han solicitado los SERVICIOS a través del SITIO WEB y/o de la APP, en el entendido que dependerá de la ubicación de las solicitudes para poder determinar la sociedad obligada.
Se entiende como “Información Personal” o “Datos Personales” o “Datos de los USUARIOS”, el nombre del USUARIO, apellidos, correo electrónico, teléfono, domicilio exacto, dirección IP y/o cualquier otra información personal requerida por YUMMY a los USUARIOS para efectos de ingresar y realizar sus transacciones en el SITIO WEB y/o APP, mediante la cual pueda individualizarse cada persona.
El presente documento se regirá e interpretará según las leyes de la República Bolivariana de Venezuela.

Los USUARIOS REGISTRADOS y los USUARIOS VISITANTES, podrán ser denominados en forma conjunta y para aquello en lo que les aplique a ambos por igual, como el “Usuario”.
Todo usuario que se registre en la plataforma de YUMMY, a través del SITIO WEB y/o APP, bajo cualquiera de las figuras establecidas, y que no haya solicitado posteriormente ser removido del registro o haya eliminado su cuenta.
Todo usuario que visite el SITIO WEB o APP como visitante, pero que no se registre.
Significa toda aquella información que, de conformidad con lo establecido en la cláusula 1.4. no representa INFORMACIÓN PERSONAL de los USUARIOS. Se entenderá entonces como propiedad de YUMMY, toda información o datos con ocasión a sus SERVICIOS prestados a través de su SITIO WEB y/o de la APP. Adicionalmente se considerará INFORMACIÓN DE YUMMY, toda aquella información desarrollada, procesada y/o sintetizada por YUMMY o terceros autorizados por ésta, con base en la INFORMACIÓN PERSONAL del USUARIO y su interacción dentro del SITIO WEB y/o APP, incluyendo de forma enunciativa pero no limitativa a aquellas descritas en la cláusula 2.1.2.
2.1. Recopilación de información. Al registrarse como USUARIO REGISTRADO, ya sea en nuestro SITIO WEB o nuestra APP, o acceder nuestros SERVICIOS o comunicarse con YUMMY como USUARIO VISITANTE en nuestro SITIO WEB, APP o cualquier otro medio, usted acepta libre y expresamente que su INFORMACIÓN PERSONAL, sea consultada, procesada, tratada y almacenada por YUMMY. Salvo que específicamente se establezca lo contrario, todos los datos que YUMMY le solicita en los procesos de registro y/o de compra de productos y/o solicitud de SERVICIOS en el SITIO WEB o en la APP son necesarios para poder hacer el registro y/o la prestación de los SERVICIOS que YUMMY ofrece. El USUARIO REGISTRADO está en la obligación de proporcionar sus DATOS PERSONALES, garantizando a su vez la veracidad de los mismos. En caso de no proporcionar sus DATOS PERSONALES, YUMMY se encuentra en la libertad y así lo acepta el USUARIO REGISTRADO, de no prestar sus servicios o bloquear su cuenta.
Los USUARIOS son quienes completan por sí mismos sus datos personales en el SITIO WEB y en la APP de YUMMY, por lo que será su responsabilidad que la información sea real, veraz, completa y actualizada al momento del ingreso de la información en la base de datos vinculada con el SITIO WEB y la APP. La omisión o inexactitud en alguno de ellos podría implicar la imposibilidad de poder prestarle los SERVICIOS solicitados y/o atender sus solicitudes y facultará a YUMMY para tomar acciones tales como pero no limitadas a: eliminar la cuenta del USUARIO, no brindar los SERVICIOS requeridos, o que los datos suministrados por el USUARIO sean eliminados de la base de datos.
2.1.1. Información que el USUARIO proporciona. Recopilamos la INFORMACIÓN PERSONAL que el USUARIO nos proporciona directamente, por ejemplo, cuando crea o modifica su cuenta, solicita o usa nuestros SERVICIOS, se pone en contacto con atención al cliente o cuando se comunica de cualquier otra forma (vía SITIO WEB, APP, teléfono, correo y cualquier otro) con nosotros en YUMMY. Esta información puede incluir, pero no está limitada a: nombre, correo electrónico, número de teléfono, dirección, foto del perfil, género, estado civil, fecha de cumpleaños, método de pago, ciertos datos de tarjeta de crédito (ver cláusula VI. de esta POLÍTICA), los artículos solicitados para servicios de entrega, notas de entrega, el contenido de la comunicación, metadatos y otra información personal que el USUARIO proporcione.
2.1.2. Información recopilada debido al uso de nuestros Servicios. Cuando el USUARIO utiliza los SERVICIOS, recopilamos INFORMACIÓN PERSONAL en las siguientes categorías generales:

El USUARIO se da por enterado con su aceptación de la presente POLÍTICA, y autoriza en forma expresa a YUMMY a realizar cualquier operación o conjunto de operaciones mediante procedimientos automatizados o manuales en relación con sus datos personales. YUMMY podrá recolectar, llevar a cabo registros, organizar, conservar, modificar, extraer, consultar, utilizar, procesar, transmitir, transferir, cotejar, bloquear, suprimir o destruir la INFORMACIÓN PERSONAL del USUARIO.
El USUARIO entiende y acepta que los procedimientos automatizados de tratamiento de datos incluyen pero no se limitan a cualquier operación, conjunto de operaciones o procedimientos que YUMMY aplique o pueda llegar a aplicar a la INFORMACIÓN PERSONAL, mediante la utilización de software, bots, inteligencia artificial, redes, aplicaciones, en sitios físicos o virtuales, o cualquier otra tecnología que permita la recolección, el registro, el acceso, la organización, la conservación, la modificación, la extracción, la consulta, la utilización, la comunicación por medio de transmisión, la transferencia, el cotejo, la interconexión, el bloqueo, la supresión, la destrucción, el intercambio o digitalización de datos personales.
La transferencia de datos que se realice de conformidad con el presente consentimiento informado se realizará bajo estándares de seguridad que garanticen al USUARIO y a YUMMY que la información será tratada, procesada y almacenada en concordancia con los fines específicos establecidos bajo la presente POLÍTICA. La INFORMACIÓN PERSONAL recolectada por YUMMY será tratada con absoluta privacidad, confidencialidad y seguridad, según estipule la LEY APLICABLE.
El USUARIO, con la lectura y aceptación expresa de esta POLÍTICA, de forma informada, individualizada, clara, precisa, inequívoca, voluntaria, libre, y consciente de los alcances de lo aquí aceptado, otorga su consentimiento informado para el tratamiento de sus datos según lo que aquí se ha indicado.
El USUARIO puede acceder a la información de su cuenta en cualquier momento, así como a solicitar el acceso, actualización, modificación y eliminación de la información contenida en ella, de forma gratuita. Si desea desactivar su cuenta, envíenos un mensaje a soporte de la APP, por medio de las líneas telefónicas disponibles en la sección de “Contáctanos” del SITIO WEB, o por los canales de atención al cliente a través de la APP. Tenga en cuenta que en algunos casos podemos retener cierta información sobre usted como lo requiera la ley o para fines comerciales legítimos en la medida permitida por la LEY APLICABLE. Por ejemplo, si usted tiene un crédito o deuda pendiente en su cuenta, o si creemos que ha cometido fraude o incumplido nuestros Términos y Condiciones, o de haber cualquier procedimiento legal actual o prospectivo. Pero en cualquiera de estos casos le será debidamente informado. El USUARIO es el único responsable por mantener su base de datos actualizada.
Respecto a cualquier otro tema relativo a la protección de datos de carácter personal, puede ponerse en contacto con nosotros mediante nuestra dirección de soporte de la APP, por medio de las líneas telefónicas disponibles en la sección de “Contáctanos” del SITIO WEB, o por los canales de atención al cliente a través de la APP.
Al aceptar nuestra Política de Privacidad y facilitar la INFORMACIÓN DE USUARIO requerida, se entenderá que el USUARIO emite formal consentimiento informado, para tratamientos de sus datos según lo establecido en la presente POLÍTICA. En este sentido, el USUARIO reconoce que: ha leído, entendido y aceptado los alcances de esta POLÍTICA; que no tiene dudas relacionadas con la forma, medio y fin para el cual se le ha solicitado la INFORMACIÓN PERSONAL; acepta en forma expresa y voluntaria su registro en nuestra Base de Datos, autoriza el tratamiento o procesamiento de la INFORMACIÓN PERSONAL otorgada, y reconoce que fue informado de los medios por los cuales podrá darse de baja de nuestra Base de Datos y/o controlar la información que proporciona a YUMMY.
Todo USUARIO REGISTRADO que utilice los SERVICIOS del SITIO WEB y/o la APP, o que nos escriba al correo electrónico, podrá recibir comunicaciones por cualquiera de estos medios o plataformas por parte de YUMMY. El USUARIO acepta que YUMMY podrá comunicar por cualquier medio registrado por el USUARIO: información sobre promociones, sobre productos, invitaciones a eventos, notificaciones sobre cambios a la presente POLÍTICA, y/o los Términos y Condiciones de YUMMY, así como cualquier otra información o notificación formal que YUMMY necesite comunicar al USUARIO.
En todas las comunicaciones electrónicas remitidas por YUMMY se informará debidamente el nombre del remitente, así como la manera en que podrá oponerse a seguir recibiendo comunicaciones.
El USUARIO autoriza la recepción de correos electrónicos por parte de YUMMY. Sin embargo, podrá, en cualquier momento, solicitar la suspensión de envío de correos a su cuenta de correo, haciendo clic en la opción de “unsubscribe” que aparece al pie de cada correo, por medio de las líneas telefónicas disponibles en la sección de “Contáctanos” del SITIO WEB, o por los canales de atención al cliente a través de la APP. No obstante, esto podrá ser motivo para cancelar los SERVICIOS al USUARIO, ya que para la correcta utilización del SITIO WEB y la APP, es fundamental para YUMMY el poder comunicarse con el USUARIO vía correo electrónico.
Cuando el USUARIO visita nuestro SITIO WEB y/o nuestra APP algunos de los datos de navegación se envían desde su computador o dispositivo móvil a nuestros servidores. Esta información permite optimizar nuestros SERVICIOS, personalizar y mejorar su experiencia en nuestro SITIO WEB o la APP. Esta información puede incluir aspectos tales como pero no limitados a:
YUMMY utiliza varias tecnologías para recopilar información cuando el USUARIO visita nuestro SITIO WEB y/o nuestra APP y esto puede incluir el envío de una o más cookies u otros identificadores para su dispositivo. Los sistemas y tecnologías que utilizamos son los siguientes:
4.1. Cookies o galletas informáticas. Una cookie es un pequeño fichero de texto que se almacena en su navegador cuando visita casi cualquier página web. Su utilidad es que la web sea capaz de recordar su visita cuando vuelva a navegar por esa página. Las cookies suelen almacenar información de carácter técnico, preferencias personales, personalización de contenidos, estadísticas de uso, enlaces a redes sociales, acceso a cuentas de USUARIO, etc. El objetivo de la cookie es adaptar el contenido de la web a su perfil y necesidades, sin cookies los servicios ofrecidos por cualquier página se verían mermados notablemente. 4.2. Web beacons o faro web. Un “web beacon” o faro web es un archivo de imagen utilizado para seguir la pista a la navegación del USUARIO por medio del SITIO WEB. Los web beacons, también llamados “web bugs” son utilizados fundamentalmente para dar seguimiento a la navegación del USUARIO por el SITIO WEB y/o la APP. Por la manera en que funciona el SITIO WEB, si el USUARIO desactiva o bloquea la utilización de este sistema, se pueden ocasionar errores en el funcionamiento y/o la utilización del SITIO WEB y/o la APP.
4.3. Web server logs. Un web server log es un archivo simple de texto que graba la actividad en un servidor. Este tipo de sistema permite obtener estadísticas sobre los patrones de navegación de los USUARIOS. Por la manera en que funciona el SITIO WEB y la APP, si el USUARIO desactiva o bloquea la utilización de este sistema, se pueden ocasionar errores en el funcionamiento y/o la utilización del SITIO WEB y la APP.
4.4. Tecnología de geolocalización. La tecnología de geolocalización permite la determinación de la ubicación del USUARIO por medio de coordenadas geográficas (latitud y longitud) en un mapa común. La información será obtenida por medio de la identificación del IP de un aparato conectado a internet, por medio de un proveedor de red, por medio de un aparato con red GSM o por medio de un GPS, por lo que serán aplicables, a tales servicios de geolocalización, los términos y condiciones del tercero proveedor. Por la manera en que funciona el SITIO WEB y la APP, si el USUARIO desactiva o bloquea la utilización de este sistema, se pueden ocasionar errores en el funcionamiento y/o la utilización del SITIO WEB y la APP.
Para evitar que su dispositivo permita el uso de las tecnologías antes dichas, el USUARIO debe rechazar la solicitud de autorización que se desplegará en la pantalla de su aparato, previo a la navegación por determinadas secciones de nuestro SITIO WEB y la APP.
Si el USUARIO tiene alguna duda sobre las tecnologías antes dichas, cómo funcionan, cómo desactivarlas o cualquier otro tipo de inquietud en relación con las que se utilizan en nuestro SITIO WEB y la APP, deberá comunicarse con nosotros por medio de las líneas telefónicas disponibles en la sección de “Contáctanos” del SITIO WEB, o por los canales de atención al cliente a través de la APP.
Nuestro SITIO WEB y nuestra APP pueden utilizar tecnologías de reorientación. Por medio de estas tecnologías de reorientación analizamos el comportamiento del USUARIO en nuestro SITIO WEB para poder ofrecer publicidad adaptada a sus necesidades individuales en páginas tales como pero no limitadas a Facebook, Instagram y Google. Estas tecnologías analizan las cookies y muestran anuncios con base en su comportamiento de navegación pasado y con base en su comportamiento de consumo.
Estamos comprometidos a proteger su INFORMACIÓN PERSONAL y hemos adoptado las medidas técnicas y organizativas adecuadas para proteger dicha información contra cualquier pérdida, alteración, acceso o uso indebido.
YUMMY le informa que la INFORMACIÓN PERSONAL es almacenada en una base de datos propiedad de esta, y se le garantizan las medidas adecuadas de índole técnica y estructural para garantizar la integridad y seguridad de la INFORMACIÓN PERSONAL aportada de acuerdo con el estado actual de la técnica.
YUMMY mantiene los niveles de seguridad de protección de sus datos conforme la LEY APLICABLE, relativo a las medidas de seguridad de las bases de datos que contengan datos de carácter personal y ha establecido todos los medios técnicos razonables a su alcance, para evitar la pérdida, mal uso, alteración, acceso no autorizado y robo de los datos que el USUARIO comunique a YUMMY, sin perjuicio de informarle de que las medidas de seguridad en Internet no son infalibles.
El USUARIO reconoce y acepta que el uso del SITIO WEB y la APP, se realiza en todo momento bajo su entero riesgo y responsabilidad. YUMMY no será responsable por el uso indebido que pueda realizarse de estos medios de comunicación y/o tecnologías.
YUMMY no será responsable por daños y perjuicios de cualquier tipo causados en los equipos electrónicos (cómputo, teléfono, tableta, u otros) del USUARIO por virus, gusanos o cualquier otro elemento dañino. El USUARIO reconoce que el uso de la red Internet supone la asunción de un riesgo de que sus equipos informáticos puedan ser afectados por los elementos antes enunciados. A tal efecto, corresponde al USUARIO, en todo caso, la disponibilidad de herramientas adecuadas para la detección y eliminación de programas electrónicos dañinos que puedan suponer un riesgo para su equipo de cómputo.
YUMMY no tendrá responsabilidad por la falta de ejecución de sus obligaciones cuando medie fuerza mayor, caso fortuito o la entrada en vigencia de legislación gubernamental, regulaciones o restricciones de cualquier otra índole que le impidan la ejecución de sus obligaciones.
YUMMY no será responsable frente al USUARIO sobre aquellos reclamos que puedan surgir relativos al uso y/o aplicación de la INFORMACIÓN DE YUMMY, en el entendido que este último reconoce que de conformidad con la cláusula 2.12., esta es propiedad de YUMMY, pudiendo hacer uso, goce y disfrute de la misma sin necesidad de mediar autorización para llevar a cabo cualquier tipo de acto que implique su cesión y/o disposición, ya sea total o parcial, gratuita u onerosa. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES, SO THAT YOU ARE SURE YOU UNDERSTAND EVERY PROVISION.
This document of Terms and Conditions of use (the “Terms and Conditions”) governs access to and use, by Users (the “Users”), whether individuals or companies, of the Yummy digital platform, website, products and services (the “Services”).
By accessing or using the Services, the User expressly and irrevocably accepts these Terms and Conditions and agrees to comply with them; they govern the relationship between the User and Yummy. If the User does not accept these Terms and Conditions, the User must not use the Services. Yummy may end these Terms and Conditions or any of the Services with immediate effect as to you or, more generally, stop offering or deny access to or use of the Services in whole or in part, at any time and for any reason. Yummy may change these Terms and Conditions relating to the Services whenever it considers it appropriate, either by publishing them on the website or by simply notifying Users through any other means it considers suitable. Changes take effect after Yummy communicates the updated Terms and Conditions for the applicable Service, by any means. Your continued access to or use of the Services after that communication is your implied and binding consent to these Terms and Conditions and their changes. The way we collect and use your personal information in connection with the Services is handled in accordance with Yummy’s privacy policies, which can be reviewed on the website or in the application.
The intermediary company domiciled in the territory where the Services were requested.
The individual who buys products and/or Services through the digital platform.
The individual who works as an independent transport operator and carries the goods bought through the digital platform.
The request placed by the User, containing all the information about the goods and/or Services bought, their payment, the delivery address, and other details.
The individual or company that offers goods and/or services through the digital platform.
The Services are a technology platform that allows Users of the Yummy mobile application to order home delivery of services or goods such as food, drinks, medicines, finished products, as well as items sold in supermarkets and convenience stores, tickets or passes for events, and/or any other lawful product supplied by Merchants that are part of the Yummy platform, provided this does not go against national laws and the item fits inside the backpacks carried by Third-Party Providers.
The User acknowledges that Yummy is only a technology platform acting as an intermediary, that it does not provide transport or logistics services, and therefore does not operate as a transport company. Those transport or logistics services are provided by independent third-party transport operators (the “Third-Party Provider”), who are not employed by Yummy and who are responsible for meeting any legal requirement or permit needed to operate and provide the service, as well as for complying with all applicable national law.
Subject to your compliance with these Terms and Conditions, Yummy grants you a limited, non-exclusive, non-sublicensable, revocable and non-transferable license to: (i) access and use the Applications on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information and related material made available through the Services; in each case for your personal, non-commercial use only. Yummy and its Licensors reserve any right not expressly granted here.
The User may not: (i) reproduce, modify, prepare derivative works of the Services, distribute, license, lease, resell, transfer, publicly display, publicly perform, transmit, retransmit or otherwise exploit the Services, except where Yummy expressly allows it; (ii) link to, mirror or frame any part of the Services; (iii) cause or launch any program or script in order to scrape, index, analyze or otherwise data-mine any part of the Services, or to unduly overload or block the operation and/or functionality of any aspect of the Services; or (iv) attempt to gain unauthorized access to or damage any aspect of the Services or their related systems or networks. The Services and all rights in them are and will remain the property of Yummy or its Licensors, in the manner and at the times Yummy decides, so granting these licenses does not transfer ownership of any right, other than those arising from the proper use of the digital platform.
In order to use most aspects of the Services, the User must register and keep an active personal User account for the Services (the “Account”). To obtain an Account you must be at least eighteen (18) years old. Registering the Account requires the User to give Yummy certain personal information, such as first and last name, address, personal and/or tax identification number, and mobile phone number. The User agrees to keep the information in the Account accurate, complete and up to date; failing to do so may result in being unable to access and use the Services, or in Yummy closing the Account. The User is responsible for all activity that takes place in the Account and agrees to keep the Account username and password safe and secret at all times. Unless Yummy allows otherwise in writing, the User may hold only one Account. Yummy reserves the right to make different types of Accounts available for different types of Users and may, at its sole discretion and without giving reasons, create, keep, manage and delete Accounts. The Account gives the User access to the Services and to features that we may create and maintain from time to time at Yummy’s sole discretion.
The Service is not available to people under eighteen (18) years of age. The User may not authorize third parties to use the Account, and may not allow people under eighteen (18) years of age to receive the Services or the goods or services provided through them. The User may not assign or otherwise transfer the Account to any other person or entity. The User agrees to comply with all applicable laws when using the Services and may use the Services only for lawful purposes (for example, they may not be used to transport unlawful or dangerous goods or substances). In some cases, Yummy may refuse the use of the Services if providing them could pose a risk to Third-Party Providers (for example, entering areas where criminal and/or terrorist groups are present, or areas that, because of their features and nearby buildings, are declared security areas by State bodies, which limits access to them, among other reasons). Yummy may also ask you to show your identity document in order to access, use or receive the Services, and if you decline to show it, access, use or delivery of the Services may be refused. Likewise, Third-Party Providers may ask to verify your identity in order to hand over the Order.
By creating an Account, the User accepts that Yummy, whether through a third-party service provider or on its own, may send communications through the following channels: text messages, pop-ups, push notifications, emails or others, as part of normal business activity and the use of the Services. The User may ask to stop receiving these informational or promotional communications from Yummy at any time, and acknowledges that asking to stop receiving them may affect how the Services work for them.
Yummy may, at its sole discretion: (i) create promotional or discount codes, (ii) grant extraordinary compensation coupons for its other verticals or applications, (iii) grant prizes for brand initiatives, which may be used according to the parameters set for the User’s single Account, or other items or benefits related to the Services and/or the services of a Third-Party Provider, subject to any additional condition that Yummy sets for each promotional code (the “Promotional Codes”).
Proper use of Promotional Codes: (i) they must be used by the User according to the parameters set and for their intended purpose, in a lawful manner; (ii) they may not be duplicated, sold or transferred in any way, or made available to the general public (whether posted on a public forum or otherwise), unless previously notified to and approved by Yummy; (iii) they may be voided by Yummy at any time for any reason, with no liability for Yummy; (iv) they are not valid as cash; (v) they may expire or reach their usage limit before being used, on the understanding that if they are not used within the following ten (10) business days they may be cancelled or lose validity. Any action by the User that goes against the above entitles Yummy, as of right, to close the Account temporarily or permanently, whenever Yummy considers it necessary.
Yummy reserves the right to withhold or deduct credit or other items or benefits obtained through the User’s use of Promotional Codes if Yummy determines or believes that the use or redemption of the Promotional Codes was mistaken, fraudulent or unlawful, or breached the conditions of the Promotional Code or these Terms. Yummy reserves the right to take whatever legal action it considers appropriate if any of the above is confirmed.
Yummy may, at its sole discretion and whenever it considers it appropriate, allow the User to submit, upload, publish or otherwise make available to Yummy through the Services text, audio and/or visual content and information, including comments and opinions about the Services, support requests, and entries for contests and promotions (the “User Content”). All User Content provided by the User remains the User’s property. However, by providing User Content to Yummy, you grant a worldwide, perpetual, irrevocable, transferable, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works from, distribute, publicly display, publicly perform or otherwise exploit that User Content in any manner, in all formats and distribution channels now known or created in the future (including in connection with the Services and Yummy’s business and on third-party sites and services), without further notice or consent and without any payment being owed to the User or to any other person or entity.
The User represents and warrants that: (i) they are the sole and exclusive owner of all the User Content, or that they have all the rights, licenses, consents and permissions needed to grant Yummy the license to the User Content described above; and (ii) neither the User Content nor its submission, upload, publication or other availability, nor Yummy’s use of the User Content as allowed here, will infringe, misappropriate or violate the intellectual property or property rights of a third party, or rights of publicity or privacy, or result in the breach of any applicable law or regulation. The User agrees not to provide User Content that is defamatory, libelous, hateful, violent, obscene, pornographic, unlawful or otherwise offensive, under applicable law or as determined by Yummy in line with its values and at its sole discretion, whether or not such material may be protected by law. Yummy may, at its sole discretion and at any time and for any reason, without prior notice, review, monitor or remove User Content, but is not obliged to do so.
The User is responsible for obtaining the data network access needed to use the Services. The data and message rates of their mobile network may apply if they access or use the Services from a mobile device, and the User will be responsible for those rates and charges. The User is responsible for acquiring and updating the compatible hardware or devices needed to access and use the Services and Applications, and any updates to them. Yummy does not guarantee that the Services, or any part of them, will work on any particular hardware or device. In addition, the Services may be subject to malfunctions or delays inherent to the use of the Internet, its upload and/or download speed, its connection and stability, and to electronic communications, and Yummy is therefore released from any damage the User may suffer in those circumstances.
Without prejudice to Yummy’s Privacy Policy, Yummy may collect and process personal information in order to connect Users with Third-Party Service Providers, link geographic information, and share Users’ phone numbers with Third-Party Providers for an efficient Service. The collection of geographic information stops after the technology platform is closed or after the Order and/or Service has been received. Yummy may use geographic location information to solve quality issues related to the Services. Yummy may collect information about the routes taken by Third-Party Providers and Users in order to analyze geographic coverage and give Third-Party Providers recommendations on more efficient delivery routes. The User’s personal information will be disclosed only to the Third-Party Provider who has agreed to provide that service, and may include the User’s name, photo, geographic location and delivery location, phone number, and other details needed to provide the Service. The User’s name and phone number will remain visible to the Third-Party Provider until the Service is finished or completed.
The User understands that using the Services may lead to charges for the Services or goods received from Yummy or from a Third-Party Provider (the “Charges”). Before or after you have received the Services or obtained the goods through the use of the Services, Yummy will facilitate payment of the applicable Charges on behalf of the Third-Party Provider, as the Third-Party Provider’s limited collection agent. Payment of the Charges in this way is treated as payment made directly by the User to the Third-Party Provider. The Charges will include applicable taxes where required by law. Charges paid by the User are final and non-refundable, as set out in Yummy’s Refund and Return Policies.
All Charges are payable immediately and payment will be facilitated by Yummy using the preferred payment method shown in your Account, after which Yummy will send you a receipt by email. If it is found that the payment method in your Account has expired, is invalid or otherwise cannot be charged, the User accepts that Yummy, as the Third-Party Provider’s limited collection agent, may debit amounts available in the Account, if any are available.
If for any reason the User cancels the order, and the cause is not attributable to Yummy, the User authorizes Yummy, without any objection, to hold the transaction amount on their debit or credit card for a period of thirty (30) days, and Yummy will allow the User to request it again only within that same period, provided the Order has not entered the preparation stage at the affiliated Merchant or been dispatched, in which case it is non-refundable. Likewise, a Service requested through Yummy and to be provided by a Third-Party Provider is deemed accepted when that Third-Party Provider accepts the Service order; that is, once the Third-Party Provider confirms that they will provide the Service. Therefore, a Service Order is deemed cancelled when the Third-Party Provider has answered the request and the User immediately rejects or cancels that Service. When a Service requested through Yummy and to be provided by a Third-Party Provider is cancelled after three (3) minutes, Yummy reserves the right to charge a cancellation fee of all or part of the Charge.
If the Third-Party Provider cannot deliver the Order or perform the Services because of force majeure, an unforeseeable external cause, or weather conditions, Yummy will not be liable for those circumstances. When the Third-Party Provider notifies the User that the requested Service has arrived and the User who requested it is not at the location shown in their Account, the Service is deemed cancelled and the User will bear the cost. In addition, the User acknowledges and accepts that the Charges applicable in certain geographic areas may increase substantially depending on the distance to those areas. However, the User is not entitled to any refund for cancellation once the Merchant or Third-Party Provider has accepted the order and it is being prepared or made. The User also understands and accepts that regular or extraordinary compensation codes granted by Yummy will be valid for a maximum of ten (10) business days.
If Yummy suspends or closes a User’s account because of behavior or activity that may be irregular, if these Terms and Conditions are terminated, or if ownership of Yummy changes, the User understands and accepts that they will not receive any refund or compensation for this, or for any content or data associated with their Account, or for anything else, unless Yummy agrees to it at its sole discretion. This payment structure is intended to fully compensate the Third-Party Provider for the Services. The User understands and accepts that, while they are free to provide an additional payment as a tip to any Third-Party Provider who provides Services to them, they are under no obligation to do so, since tips to the Third-Party Provider are voluntary. After you have received or completed the Services, you will have the chance to rate your experience and leave additional comments about Yummy and the Third-Party Provider.
The User releases Yummy from all liability regarding orders that the User has received and accepted with the security and warranty seal broken or open, on the understanding that the User may not make claims against Yummy on any ground, since the User is required to refuse delivery of orders whose security and warranty seal shows irregularities or shows signs of having been broken, since any third party could have accessed or tampered with the contents of the order.
The User declares that they will not dispute payments made to Yummy for Orders actually received and/or Services actually provided, or for those where refunds do or do not apply under any circumstances. The User must report any incident through the customer support channel inside the digital platform, where the Yummy team will assess the case and decide whether a refund applies, as well as the percentage of the amount paid that it represents, in accordance with the previous clause.
DISCLAIMER: YUMMY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, THAT ARE NOT EXPRESSLY SET OUT IN THESE TERMS AND CONDITIONS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, YUMMY MAKES NO REPRESENTATION AND GIVES NO WARRANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF THE SERVICES OR OF ANY OF THE SERVICES OR GOODS REQUESTED THROUGH THE USE OF THE SERVICES, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. YUMMY DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY OR ABILITY OF THIRD-PARTY PROVIDERS. YOU AGREE THAT THE ENTIRE RISK ARISING FROM YOUR USE OF THE SERVICES OR ANY GOOD REQUESTED IN CONNECTION WITH THEM IS YOURS ALONE, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW.
LIMITATION OF LIABILITY: YUMMY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, PERSONAL INJURY OR PROPERTY DAMAGE, NOR FOR LOSSES RELATING TO, IN CONNECTION WITH, OR OTHERWISE ARISING FROM ANY USE OF THE SERVICES, EVEN IF YUMMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YUMMY WILL NOT BE LIABLE FOR ANY DAMAGE, LIABILITY OR LOSS ARISING FROM: (I) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; OR (II) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY THIRD-PARTY PROVIDER, EVEN IF YUMMY HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YUMMY WILL NOT BE LIABLE FOR DELAY OR FAILURE TO PERFORM RESULTING FROM CAUSES BEYOND YUMMY’S REASONABLE CONTROL. THE LIMITATIONS AND DISCLAIMER IN THIS SECTION ARE NOT INTENDED TO LIMIT LIABILITY OR CHANGE YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
Indemnity: You agree to hold harmless and answer to Yummy and its board members, officers, employees and agents for any claim, demand, loss, liability and expense (including attorneys’ fees) arising from: (i) your use of the Services or of services or goods obtained through the use of the Services; (ii) your breach or violation of any of these Terms and Conditions; (iii) Yummy’s use of your User Content; or (iv) your infringement of the rights of any third party, including Third-Party Providers.
Any dispute directly or indirectly related to this contract between the User and Yummy will be resolved by arbitration at law, in accordance with the laws of the country where the services were requested through the Yummy platform, in the capital city of that country, in Spanish, by an arbitrator of the arbitral jurisdiction to which the parties expressly declare they submit.
Notices: Yummy may notify the User through a general notice in the Services, by an email sent to the email address given in their Account, or by written communication sent to their address as given in their Account. You may notify Yummy by written communication to the Yummy address shown in the “Contact us” section of the Yummy website for the territory where the services were requested. If the written notice is sent to another address, it will not be valid.
General provisions. The User may not assign or transfer these Terms and Conditions, in whole or in part, without Yummy’s prior written consent.
The User approves Yummy assigning or transferring these Terms and Conditions, in whole or in part, including to: (i) a subsidiary or an affiliate; (ii) an acquirer of Yummy’s equity, business or assets; or (iii) a successor by merger. There is no joint venture or partnership, employment or agency relationship between you, Yummy or any Third-Party Provider as a result of the contract between the User and Yummy or of the use of the Services.
If any provision of these Terms and Conditions is held to be unlawful, void or unenforceable, in whole or in part, under applicable law, that provision or part of it will be treated as removed from these Terms and Conditions; however, the legality, validity and enforceability of the remaining provisions of these Terms and Conditions will not be affected. In that case, the parties must replace the unlawful, void or unenforceable provision, in whole or in part, with a lawful, valid and enforceable provision that has, as far as possible, a similar effect to the unlawful, void or unenforceable provision, given the content and purpose of these Terms and Conditions.
These Terms and Conditions are the entire contract and understanding between the parties in relation to their subject matter, and supersede and replace all prior or contemporaneous contracts or agreements on that subject matter. In these Terms and Conditions, the words “including” and “includes” mean “including, without limitation”.
At the time the Product is delivered, it is the User’s responsibility (or that of the person receiving the Product on their behalf) to check that it is in perfect condition, with the security seals intact and with no defects. The User may file a claim about Perishable Products (prepared food and drink) within no more than twelve (12) hours, and about Non-Perishable Products within no more than twenty-four (24) hours from receipt.

Yummy will not be required to refund any amount to the User in the following cases:
For this purpose, the User must file their request through the Customer Support Chat in the Application, explaining the reasons for the claim and attaching the evidence that supports it. Yummy will assess each request, with the reasons given, to confirm whether the claim applies, and will reply to the User within no more than five (5) business days from receipt of the claim. To assess the request, Yummy may ask for a description of the problem, information about the order, photos of the relevant Product, videos, verification of the payment and of the User’s identity, and any other item relevant to reviewing the case.
For returns of Yummy Shop products, the User must contact or go to the Merchant to request the exchange directly with them, and it is recommended that this be done having met the following conditions: the Product must not have been used, nor show wear or damage of any kind; the Product must have its original packaging, meaning that the Product must be in the same condition in which it was delivered to the User, including all labels, manuals or packaging; and the User must give the order number from the application and show the purchase receipt or proof of payment. In the case of supermarket and pharmacy orders, the User will only receive a refund of the order subtotal, not including delivery charges and/or service fees.
The refund of money or replacement of the product will be at no cost to the User once Yummy has accepted and reviewed that the refund or replacement applies according to its verification criteria. The money will be refunded using the payment method the User originally used, and by transfer to the bank account the User indicates for this purpose. Refunds may take between two (2) and fifteen (15) business days from the moment Yummy verifies that the claim applies. Yummy will not be responsible for the processing times of those refunds that are attributable to the different financial institutions once the refund has been instructed.
Where the User chooses “Balance in your Profile” as the refund method, they will have fifteen (15) days to use it and/or request a refund to their bank account within that period. The User may cancel any service or product request in the application, provided the order has not changed its status from “order placed” to “order in preparation”. If the Merchant or Third-Party Provider has accepted the order and started preparing it, the User is not entitled to any refund or compensation for cancellation. If Yummy suspends or closes their account on suspicion of irregular or fraudulent activity, or if ownership of Yummy changes, the User understands and accepts that they will NOT receive any refund or compensation for this, or for any content or data associated with their account, or for anything else, unless, after carrying out the relevant verification, Yummy agrees to it at its sole discretion.
Through this Privacy and Security Policy, at YUMMY we inform you about the points you should know and authorize regarding the privacy of your data on this WEBSITE and/or APP installed on mobile devices or tablets. We inform you that we keep a database in which we collect, process and store your PERSONAL INFORMATION, for the purposes set out below.
The application for devices, including but not limited to the IOS and Android operating systems, owned by YUMMY and made available to USERS.
The occurrence of an event or circumstance (a “Force Majeure Event”) that makes it impossible or prevents a party from performing one or more of its contractual obligations under the contract, to the extent that the party affected by the impediment proves: (a) that the impediment is beyond its reasonable control; and (b) that the effects of the impediment could not reasonably have been avoided or overcome by the Affected Party.
Any company incorporated under the laws of the territory where the SERVICES were requested through the WEBSITE and/or the APP, on the understanding that the obligated company depends on the location of the requests.
“Personal Information”, “Personal Data” or “User Data” means the USER’s first name, last name, email address, phone number, exact home address, IP address and/or any other personal information that YUMMY requires from USERS in order for them to sign in and carry out their transactions on the WEBSITE and/or APP, and by which each person can be identified.
This document is governed by and interpreted under the laws of the Bolivarian Republic of Venezuela.

REGISTERED USERS and VISITING USERS may be referred to together, where the same rules apply to both, as the “User”.
Any user who registers on the YUMMY platform, through the WEBSITE and/or APP, under any of the available options, and who has not later asked to be removed from the register or deleted their account.
Any user who visits the WEBSITE or APP as a visitor but does not register.
All information that, under clause 1.4, is not PERSONAL INFORMATION of USERS. All information or data arising from its SERVICES provided through its WEBSITE and/or the APP is therefore understood to be the property of YUMMY. YUMMY INFORMATION also includes all information developed, processed and/or synthesized by YUMMY or by third parties authorized by it, based on the USER’s PERSONAL INFORMATION and their interaction within the WEBSITE and/or APP, including but not limited to the information described in clause 2.1.2.
2.1. Collection of information. When registering as a REGISTERED USER, whether on our WEBSITE or our APP, or when accessing our SERVICES or contacting YUMMY as a VISITING USER on our WEBSITE, APP or by any other means, you freely and expressly accept that your PERSONAL INFORMATION may be consulted, processed, handled and stored by YUMMY. Unless specifically stated otherwise, all the data that YUMMY asks you for during registration and/or product purchase and/or SERVICE requests on the WEBSITE or in the APP is needed to complete registration and/or to provide the SERVICES that YUMMY offers. The REGISTERED USER is required to provide their PERSONAL DATA and to guarantee that it is accurate. If the PERSONAL DATA is not provided, YUMMY is free — and the REGISTERED USER accepts this — not to provide its services or to block the account.
USERS themselves enter their personal data on the YUMMY WEBSITE and APP, so it is their responsibility that the information is real, accurate, complete and up to date at the time it is entered into the database linked to the WEBSITE and the APP. Omitting or misstating any of it could make it impossible to provide the SERVICES requested and/or handle their requests, and entitles YUMMY to take actions such as, but not limited to: deleting the USER’s account, not providing the requested SERVICES, or deleting the data supplied by the USER from the database.
2.1.1. Information the USER provides. This information may include, but is not limited to: name, email address, phone number, address, profile photo, gender, marital status, date of birth, payment method, certain credit card details (see clause VI of this POLICY), the items requested for delivery services, delivery notes, the content of the communication, metadata and other personal information the USER provides.

By accepting this POLICY the USER acknowledges this, and expressly authorizes YUMMY to carry out any operation or set of operations, by automated or manual means, in relation to their personal data. YUMMY may collect, record, organize, keep, modify, extract, consult, use, process, transmit, transfer, compare, block, delete or destroy the USER’s PERSONAL INFORMATION.
The USER understands and accepts that automated data processing procedures include but are not limited to any operation, set of operations or procedures that YUMMY applies or may come to apply to the PERSONAL INFORMATION, using software, bots, artificial intelligence, networks, applications, in physical or virtual places, or any other technology that allows the collection, recording, access, organization, storage, modification, extraction, consultation, use, communication by transmission, transfer, comparison, interconnection, blocking, deletion, destruction, exchange or digitization of personal data.
Any data transfer carried out under this informed consent will be made under security standards that assure the USER and YUMMY that the information will be handled, processed and stored in line with the specific purposes set out in this POLICY. The PERSONAL INFORMATION collected by YUMMY will be handled with full privacy, confidentiality and security, as APPLICABLE LAW requires.
By reading and expressly accepting this POLICY — in an informed, individual, clear, precise, unambiguous, voluntary and free manner, and aware of the scope of what is accepted here — the USER gives their informed consent for their data to be processed as described here.
The USER may access their account information at any time, and may request access to, updating, modification and deletion of the information it contains, free of charge. If you wish to deactivate your account, send us a message to APP support, through the phone lines available in the “Contact us” section of the WEBSITE, or through the customer support channels in the APP. Please note that in some cases we may keep certain information about you as required by law or for legitimate business purposes to the extent allowed by APPLICABLE LAW. For example, if you have credit or an outstanding debt on your account, or if we believe you have committed fraud or breached our Terms and Conditions, or if there is any current or prospective legal proceeding. In any of these cases you will be duly informed. The USER is solely responsible for keeping their own records up to date.

By accepting our Privacy Policy and providing the required USER INFORMATION, the USER is understood to give formal informed consent for their data to be processed as set out in this POLICY. In this regard, the USER acknowledges that: they have read, understood and accepted the scope of this POLICY; that they have no doubts about the manner, means and purpose for which the PERSONAL INFORMATION has been requested; they expressly and voluntarily accept their registration in our Database, authorize the handling or processing of the PERSONAL INFORMATION given, and acknowledge that they were informed of the means by which they can remove themselves from our Database and/or control the information they provide to YUMMY.
Any REGISTERED USER who uses the SERVICES of the WEBSITE and/or the APP, or who writes to us by email, may receive communications from YUMMY through any of these channels or platforms. The USER accepts that YUMMY may communicate, through any channel registered by the USER: information about promotions and products, invitations to events, notices about changes to this POLICY and/or to YUMMY’s Terms and Conditions, as well as any other information or formal notice that YUMMY needs to communicate to the USER.
All electronic communications sent by YUMMY will duly state the sender’s name, as well as how you can opt out of receiving further communications.
The USER authorizes the receipt of emails from YUMMY. However, they may at any time ask to stop emails being sent to their email account by clicking the “unsubscribe” option at the bottom of each email, through the phone lines available in the “Contact us” section of the WEBSITE, or through the customer support channels in the APP. However, this may be grounds for cancelling the SERVICES for the USER, since being able to communicate with the USER by email is essential for YUMMY for the proper use of the WEBSITE and the APP.
When the USER visits our WEBSITE and/or our APP, some browsing data is sent from their computer or mobile device to our servers. This information allows us to optimize our SERVICES and to personalize and improve their experience on our WEBSITE or the APP. This information may include items such as but not limited to:
YUMMY uses several technologies to collect information when the USER visits our WEBSITE and/or our APP, and this may include sending one or more cookies or other identifiers to their device. The systems and technologies we use are the following:
4.1. Cookies. A cookie is a small text file stored in your browser when you visit almost any web page. Its purpose is to allow the site to remember your visit when you browse that page again. Cookies usually store technical information, personal preferences, content personalization, usage statistics, links to social networks, access to USER accounts, and so on. 4.2. Web beacons. A “web beacon” is an image file used to track the USER’s browsing across the WEBSITE. Web beacons, also called “web bugs”, are used mainly to track the USER’s browsing across the WEBSITE and/or the APP. Because of the way the WEBSITE works, if the USER disables or blocks the use of this system, errors may occur in the operation and/or use of the WEBSITE and/or the APP.
4.3. Web server logs. A web server log is a plain text file that records activity on a server. This type of system makes it possible to obtain statistics about USERS’ browsing patterns. Because of the way the WEBSITE and the APP work, if the USER disables or blocks the use of this system, errors may occur in the operation and/or use of the WEBSITE and the APP.
4.4. Geolocation technology. Geolocation technology makes it possible to determine the USER’s location through geographic coordinates (latitude and longitude) on a common map. The information is obtained by identifying the IP of a device connected to the internet, through a network provider, through a device with a GSM network, or through GPS, so the terms and conditions of the third-party provider apply to those geolocation services. Because of the way the WEBSITE and the APP work, if the USER disables or blocks the use of this system, errors may occur in the operation and/or use of the WEBSITE and the APP.

These technologies analyze cookies and show ads based on your past browsing behavior and on your buying behavior.
We are committed to protecting your PERSONAL INFORMATION and have adopted the appropriate technical and organizational measures to protect that information against loss, alteration, improper access or misuse.
YUMMY informs you that the PERSONAL INFORMATION is stored in a database owned by YUMMY, and you are assured of appropriate technical and structural measures to guarantee the integrity and security of the PERSONAL INFORMATION provided, in line with the current state of the art.
YUMMY maintains the levels of data protection security required by APPLICABLE LAW regarding security measures for databases containing personal data, and has put in place all reasonable technical means available to it to prevent the loss, misuse, alteration, unauthorized access and theft of the data that the USER shares with YUMMY, while informing you that security measures on the Internet are not infallible.
The USER acknowledges and accepts that the use of the WEBSITE and the APP is at all times at their own risk and responsibility. YUMMY will not be liable for any misuse of these communication channels and/or technologies.
YUMMY will not be liable for damages of any kind caused to the USER’s electronic equipment (computer, phone, tablet or others) by viruses, worms or any other harmful element. The USER acknowledges that using the Internet carries the risk that their computer equipment may be affected by the elements listed above. Accordingly, it is in all cases the USER’s responsibility to have suitable tools available for detecting and removing harmful electronic programs that may pose a risk to their computer equipment.
YUMMY will not be liable for failure to perform its obligations where force majeure, an act of God, or the entry into force of government legislation, regulations or restrictions of any other kind prevent it from performing them.
YUMMY will not be liable to the USER for claims that may arise regarding the use and/or application of YUMMY INFORMATION, on the understanding that the USER acknowledges that, under clause 2.12, this is the property of YUMMY, which may use and enjoy it without needing authorization to carry out any act involving its assignment and/or disposal, whether in whole or in part, free of charge or for consideration. In this regard, the USER expressly waives any claim in connection with their PERSONAL INFORMATION processed by YUMMY and/or by third parties authorized to do so under clause 2.2, through which YUMMY INFORMATION is produced or developed.
YUMMY reserves the right to make changes or adjustments to this Privacy Policy whenever it considers it appropriate or necessary. Changes or adjustments to this POLICY will be notified to USERS when they use the SERVICES or through one of the established contact channels.
