ESTA POLÍTICA EXPLICA QUÉ DATOS PERSONALES TRATA Yummy SuperApp, PARA QUÉ LOS USA, CON QUIÉN LOS COMPARTE Y CÓMO PUEDE EL TITULAR EJERCER SUS DERECHOS. APLICA TANTO A PASAJEROS COMO A CONDUCTORES. LÉALA DETENIDAMENTE ANTES DE USAR LOS SERVICIOS.
La presente Política de Privacidad y Tratamiento de Datos Personales (la “POLÍTICA”) regula la forma en que YUMMY recopila, usa, almacena, comparte y protege la INFORMACIÓN PERSONAL de las personas que utilizan Yummy SuperApp, el servicio de movilidad de la plataforma Yummy, ya sea a través de la aplicación Yummy SuperApp, de la sección de viajes de Yummy SuperApp, del SITIO WEB o de cualquier otro canal habilitado (los “SERVICIOS”).
Esta POLÍTICA aplica a los PASAJEROS que solicitan viajes, a los CONDUCTORES que ofrecen viajes a través de la plataforma, a los aspirantes a CONDUCTOR durante el proceso de registro, y a los terceros cuyos datos nos son facilitados en el marco de los SERVICIOS (por ejemplo, contactos de emergencia o personas para quienes se solicita un viaje).
El responsable del tratamiento es la sociedad mercantil que opera los SERVICIOS en el territorio donde fueron solicitados, en los términos definidos en los Términos y Condiciones de Yummy. Esta POLÍTICA complementa la Política de Privacidad y Seguridad incluida en dichos Términos y Condiciones; en lo relativo al servicio de movilidad, prevalece lo dispuesto en este documento.
Al registrarse o utilizar los SERVICIOS, el USUARIO declara haber leído esta POLÍTICA y otorga su consentimiento libre, expreso e informado para el tratamiento de su INFORMACIÓN PERSONAL en los términos aquí descritos. Para el tratamiento de DATOS SENSIBLES, YUMMY solicitará un consentimiento adicional y específico dentro de la APP.
La sociedad mercantil que opera la plataforma Yummy y el servicio Yummy SuperApp en el territorio donde se solicitan los SERVICIOS, responsable del tratamiento de la INFORMACIÓN PERSONAL.
Toda persona natural que accede o utiliza los SERVICIOS, sea como PASAJERO o como CONDUCTOR.
El USUARIO que solicita, programa o realiza un viaje a través de la plataforma, para sí o para un tercero.
La persona natural, tercero independiente, que presta servicios de transporte a los PASAJEROS utilizando la plataforma, así como el aspirante que se encuentra en proceso de registro y verificación.
Cualquier información concerniente a una persona natural identificada o identificable, incluyendo, entre otros, nombre, cédula de identidad, teléfono, correo electrónico, fotografía, ubicación, datos del vehículo y del dispositivo.
Aquella INFORMACIÓN PERSONAL cuyo uso indebido puede generar discriminación o un riesgo grave para su titular, como los datos biométricos (reconocimiento facial), los antecedentes penales, los datos de salud contenidos en certificados médicos y las grabaciones de audio o video del viaje.
Cualquier operación sobre INFORMACIÓN PERSONAL, como su recolección, registro, almacenamiento, consulta, uso, transmisión, actualización o supresión.
El tercero que trata INFORMACIÓN PERSONAL por cuenta de YUMMY y siguiendo sus instrucciones, como proveedores de alojamiento, mapas, pagos, mensajería o verificación de identidad.
El tratamiento de la INFORMACIÓN PERSONAL se rige por las leyes de la República Bolivariana de Venezuela, en particular por el artículo 28 de la Constitución, que consagra el derecho de toda persona a acceder a la información y a los datos que sobre sí misma consten en registros oficiales o privados, a conocer el uso que se haga de ellos y su finalidad, y a solicitar su actualización, rectificación o destrucción (habeas data); por el artículo 60, que protege el honor, la vida privada, la intimidad y la propia imagen, y ordena limitar el uso de la informática para garantizarlos; y por el artículo 48, que garantiza el secreto de las comunicaciones privadas.
Asimismo, YUMMY observa la Ley Especial contra los Delitos Informáticos, la Ley sobre Mensajes de Datos y Firmas Electrónicas, la Ley Orgánica para la Protección de Niños, Niñas y Adolescentes, la normativa de transporte terrestre aplicable a los CONDUCTORES y sus vehículos, y la normativa tributaria y de prevención de legitimación de capitales que resulte aplicable a las operaciones de pago.
En atención a los principios desarrollados por la Sala Constitucional del Tribunal Supremo de Justicia (sentencia N° 1318 del 4 de agosto de 2011), YUMMY trata la INFORMACIÓN PERSONAL conforme a los siguientes principios:
El USUARIO puede crear su cuenta o iniciar sesión en los SERVICIOS con su cuenta de Google. En ese caso, y solo con la autorización que el USUARIO otorga en la pantalla de consentimiento de Google, YUMMY recibe los siguientes datos de su cuenta de Google: nombre, dirección de correo electrónico, fotografía de perfil e identificador de la cuenta de Google. YUMMY no recibe ni tiene acceso a la contraseña de Google del USUARIO.
Uso. YUMMY usa los datos de usuario de Google exclusivamente para autenticar al USUARIO, crear y vincular su cuenta, completar su perfil y comunicarse con él sobre los SERVICIOS. YUMMY no usa los datos de usuario de Google para publicidad, no los vende, no los usa para elaborar perfiles con fines comerciales ni para determinar la solvencia crediticia del USUARIO, y no los utiliza para entrenar modelos de inteligencia artificial generalistas.
Transferencia. YUMMY no transfiere los datos de usuario de Google a terceros, salvo a los Encargados que proveen la infraestructura de autenticación y alojamiento, en la medida necesaria para prestar los SERVICIOS, cuando lo exija la ley, o como parte de una operación societaria con aviso previo al USUARIO. Ninguna persona de YUMMY lee estos datos, salvo con el consentimiento expreso del USUARIO, cuando sea necesario por motivos de seguridad o investigación de abusos, o para cumplir la ley.
Almacenamiento y protección. Los datos de usuario de Google se almacenan cifrados en tránsito y en reposo, con acceso restringido al personal autorizado, y se conservan mientras la cuenta esté activa.
Revocación y eliminación. El USUARIO puede revocar en cualquier momento el acceso de YUMMY a su cuenta de Google desde myaccount.google.com/permissions, y solicitar la eliminación de sus datos escribiendo a info@yummysuperapp.com o desde la opción de eliminar cuenta de la APP. YUMMY eliminará los datos de usuario de Google dentro de los treinta (30) días siguientes a la solicitud.
El uso y la transferencia a cualquier otra aplicación de la información recibida de las API de Google por parte de YUMMY se ajustará a la Política de Datos de Usuario de los Servicios de API de Google, incluidos los requisitos de Uso Limitado.
Si el USUARIO inicia sesión con otros proveedores, como Apple, YUMMY aplica los mismos criterios a los datos que dichos proveedores comparten.
La ubicación es indispensable para prestar un servicio de movilidad: permite asignar el CONDUCTOR más cercano, calcular la tarifa, trazar la ruta, estimar tiempos de llegada y atender emergencias.
Pasajeros. YUMMY recopila la ubicación precisa del dispositivo del PASAJERO mientras la APP está abierta, y durante el viaje aun cuando la APP se encuentre en segundo plano, desde la solicitud hasta poco después de su finalización. El PASAJERO puede negar o revocar el permiso de ubicación desde la configuración de su dispositivo; en ese caso deberá indicar manualmente su punto de partida, y algunas funciones, como la asignación rápida o el botón de emergencia con ubicación, podrán verse limitadas.
Conductores. YUMMY recopila la ubicación precisa del dispositivo del CONDUCTOR de forma continua mientras se encuentre conectado y disponible para recibir viajes o realizando un viaje, incluso cuando la APP esté en segundo plano o con la pantalla apagada. Esta recopilación es necesaria para asignarle solicitudes, registrar la ruta y garantizar la seguridad de ambas partes. YUMMY no recopila la ubicación del CONDUCTOR cuando este se encuentra desconectado.
Durante un viaje, la ubicación del CONDUCTOR se muestra al PASAJERO, y la ubicación del punto de partida del PASAJERO se muestra al CONDUCTOR. Si el USUARIO comparte su viaje, las personas que elija podrán ver la ruta en tiempo real hasta que el viaje termine.
Para proteger a PASAJEROS y CONDUCTORES contra la suplantación de identidad y el uso fraudulento de cuentas, YUMMY puede solicitar la captura de fotografías o video del rostro del USUARIO y compararlos con la fotografía de su documento de identidad o de su perfil. En el caso de los CONDUCTORES, esta verificación se realiza durante el registro y de forma periódica o aleatoria antes de conectarse.
Los datos biométricos son DATOS SENSIBLES y su tratamiento se sujeta a las siguientes reglas:
Igualmente, los certificados de antecedentes penales y médicos de los CONDUCTORES se tratan como DATOS SENSIBLES, solo son consultados por el personal autorizado del proceso de habilitación, y se usan exclusivamente para evaluar la idoneidad del aspirante para prestar servicios de transporte de forma segura.
YUMMY ofrece herramientas de seguridad que implican el tratamiento de INFORMACIÓN PERSONAL adicional:
YUMMY trata la INFORMACIÓN PERSONAL para las siguientes finalidades:
YUMMY puede usar procesos automatizados para asignar viajes, calcular tarifas dinámicas y detectar fraude. Cuando una decisión automatizada pueda derivar en la suspensión o desactivación de una cuenta, el USUARIO podrá solicitar su revisión por una persona y presentar sus argumentos.
YUMMY no vende la INFORMACIÓN PERSONAL de sus USUARIOS. Solo la compartimos en los siguientes casos:
Algunos de nuestros Encargados, como los proveedores de alojamiento en la nube, mapas o verificación de identidad, pueden almacenar o procesar INFORMACIÓN PERSONAL en servidores ubicados fuera de Venezuela. En esos casos, YUMMY exige contractualmente a dichos proveedores un nivel de protección equivalente al descrito en esta POLÍTICA, incluyendo obligaciones de confidencialidad, seguridad y uso limitado. Al aceptar esta POLÍTICA, el USUARIO consiente dichas transferencias.
YUMMY conserva la INFORMACIÓN PERSONAL mientras la cuenta esté activa y, después de su eliminación, solo durante el tiempo necesario para cumplir obligaciones legales, resolver disputas, prevenir fraude y hacer valer sus derechos. Como referencia:
Conforme al artículo 28 de la Constitución, el titular de la INFORMACIÓN PERSONAL tiene derecho, de forma gratuita, a:
Para ejercer estos derechos, el titular puede escribir a info@yummysuperapp.com indicando su nombre, el teléfono o correo asociado a su cuenta y el derecho que desea ejercer, o utilizar los canales de atención al cliente de la APP. Para proteger la cuenta, YUMMY podrá solicitar información adicional que permita verificar la identidad del solicitante. YUMMY responderá dentro de los quince (15) días hábiles siguientes a la recepción de una solicitud completa.
Lo anterior no limita el derecho del titular a ejercer la acción de habeas data ante los tribunales competentes.
Los SERVICIOS no están dirigidos a personas menores de dieciocho (18) años, quienes no pueden crear una cuenta como PASAJERO ni como CONDUCTOR. Un menor de edad solo puede viajar acompañado por un adulto titular de una cuenta, o en los casos que YUMMY habilite expresamente, bajo la responsabilidad de su representante legal. Si YUMMY detecta que ha recopilado datos de un menor sin la autorización correspondiente, los eliminará.
El SITIO WEB y la APP utilizan cookies, SDK, píxeles y tecnologías similares para mantener la sesión, recordar preferencias, medir el uso de los SERVICIOS, detectar fraude y mostrar publicidad adaptada a los intereses del USUARIO en plataformas de terceros, conforme a lo descrito en la Política de Privacidad y Seguridad de los Términos y Condiciones. El USUARIO puede bloquear o eliminar las cookies desde la configuración de su navegador, y restablecer o limitar el identificador de publicidad desde la configuración de su dispositivo.
YUMMY aplica medidas técnicas y organizativas razonables para proteger la INFORMACIÓN PERSONAL contra pérdida, alteración, acceso o uso no autorizado, entre ellas: cifrado de los datos en tránsito y, para los DATOS SENSIBLES, en reposo; control de acceso basado en funciones y con el menor privilegio necesario; registro de accesos; enmascaramiento de números telefónicos; y obligaciones de confidencialidad para empleados y Encargados.
Ningún sistema es completamente infalible. Si ocurre un incidente de seguridad que comprometa la INFORMACIÓN PERSONAL y represente un riesgo para los titulares, YUMMY adoptará las medidas necesarias para contenerlo y notificará a los USUARIOS afectados sin demora injustificada, indicando la naturaleza del incidente y las medidas recomendadas. El USUARIO es responsable de mantener la confidencialidad de sus credenciales de acceso y de notificar a YUMMY cualquier uso no autorizado de su cuenta.
YUMMY enviará al USUARIO notificaciones operativas necesarias para la prestación de los SERVICIOS, como el estado del viaje, recibos, alertas de seguridad y cambios en la cuenta o en esta POLÍTICA; estas comunicaciones no pueden desactivarse mientras la cuenta esté activa.
Las comunicaciones promocionales, enviadas por notificación push, correo electrónico, SMS, WhatsApp u otros medios, pueden desactivarse en cualquier momento desde la configuración de la APP, mediante el enlace de baja incluido en cada correo o escribiendo a info@yummysuperapp.com. Darse de baja de las comunicaciones promocionales no afecta el uso de los SERVICIOS.
YUMMY podrá modificar esta POLÍTICA para reflejar cambios en los SERVICIOS, en la ley o en sus prácticas. Los cambios se publicarán en esta página con su fecha de actualización. Cuando los cambios sean sustanciales, en especial si amplían las finalidades o el tratamiento de DATOS SENSIBLES, YUMMY lo notificará a los USUARIOS por la APP o por correo electrónico antes de su entrada en vigor y, cuando la ley lo exija, solicitará un nuevo consentimiento.
Para cualquier consulta, solicitud o reclamo relacionado con esta POLÍTICA o con el tratamiento de su INFORMACIÓN PERSONAL, el USUARIO puede contactar a YUMMY en info@yummysuperapp.com, a través de los canales de atención al cliente de la APP o en el Centro de ayuda.

THIS POLICY EXPLAINS WHAT PERSONAL DATA Yummy SuperApp PROCESSES, WHAT IT USES IT FOR, WHO IT SHARES IT WITH AND HOW THE DATA SUBJECT CAN EXERCISE THEIR RIGHTS. IT APPLIES TO BOTH RIDERS AND DRIVERS. PLEASE READ IT CAREFULLY BEFORE USING THE SERVICES.
This Privacy and Personal Data Processing Policy (the “POLICY”) governs how YUMMY collects, uses, stores, shares and protects the PERSONAL INFORMATION of people who use Yummy SuperApp, the mobility service of the Yummy platform, whether through the Yummy SuperApp app, the rides section of Yummy SuperApp, the WEBSITE or any other enabled channel (the “SERVICES”).
This POLICY applies to RIDERS who request trips, to DRIVERS who offer trips through the platform, to DRIVER applicants during the sign-up process, and to third parties whose data is provided to us in connection with the SERVICES (for example, emergency contacts or people for whom a trip is requested).
The data controller is the company that operates the SERVICES in the territory where they were requested, as defined in Yummy’s Terms and Conditions. This POLICY supplements the Privacy and Security Policy included in those Terms and Conditions; for the mobility service, this document prevails.
By signing up for or using the SERVICES, the USER states that they have read this POLICY and gives their free, express and informed consent to the processing of their PERSONAL INFORMATION as described here. For the processing of SENSITIVE DATA, YUMMY will ask for additional, specific consent within the APP.
The company that operates the Yummy platform and the Yummy SuperApp service in the territory where the SERVICES are requested, and which is the controller of the PERSONAL INFORMATION.
Any individual who accesses or uses the SERVICES, whether as a RIDER or as a DRIVER.
The USER who requests, schedules or takes a trip through the platform, for themselves or for a third party.
The individual, an independent third party, who provides transportation services to RIDERS using the platform, as well as the applicant who is going through sign-up and verification.
Any information about an identified or identifiable individual, including, among others, name, identity card number, phone, email, photo, location, and vehicle and device data.
PERSONAL INFORMATION whose misuse may lead to discrimination or a serious risk to its owner, such as biometric data (facial recognition), criminal records, health data contained in medical certificates, and audio or video recordings of the trip.
Any operation on PERSONAL INFORMATION, such as its collection, recording, storage, consultation, use, transmission, updating or deletion.
A third party that processes PERSONAL INFORMATION on behalf of YUMMY and following its instructions, such as hosting, maps, payments, messaging or identity verification providers.
The processing of PERSONAL INFORMATION is governed by the laws of the Bolivarian Republic of Venezuela, in particular by Article 28 of the Constitution, which establishes everyone’s right to access the information and data about themselves held in official or private records, to know how and why they are used, and to request their updating, correction or destruction (habeas data); by Article 60, which protects honor, private life, privacy and one’s own image, and requires limiting the use of information technology to guarantee them; and by Article 48, which guarantees the secrecy of private communications.
YUMMY also complies with the Special Law against Computer Crimes, the Law on Data Messages and Electronic Signatures, the Organic Law for the Protection of Children and Adolescents, the land transportation rules that apply to DRIVERS and their vehicles, and the tax and anti-money-laundering rules that apply to payment transactions.
In line with the principles set out by the Constitutional Chamber of the Supreme Court of Justice (ruling No. 1318 of August 4, 2011), YUMMY processes PERSONAL INFORMATION under the following principles:
The USER may create their account or sign in to the SERVICES with their Google account. In that case, and only with the authorization the USER gives on Google’s consent screen, YUMMY receives the following data from their Google account: name, email address, profile photo and Google account identifier. YUMMY does not receive or have access to the USER’s Google password.
Use. YUMMY uses Google user data only to authenticate the USER, create and link their account, complete their profile and communicate with them about the SERVICES. YUMMY does not use Google user data for advertising, does not sell it, does not use it to build profiles for commercial purposes or to determine the USER’s creditworthiness, and does not use it to train general-purpose artificial intelligence models.
Transfer. YUMMY does not transfer Google user data to third parties, except to the Processors that provide the authentication and hosting infrastructure, to the extent needed to provide the SERVICES, when required by law, or as part of a corporate transaction with prior notice to the USER. No person at YUMMY reads this data, except with the USER’s express consent, when needed for security purposes or to investigate abuse, or to comply with the law.
Storage and protection. Google user data is stored encrypted in transit and at rest, with access restricted to authorized staff, and is kept while the account is active.
Revocation and deletion. The USER may revoke YUMMY’s access to their Google account at any time at myaccount.google.com/permissions, and request deletion of their data by writing to info@yummysuperapp.com or through the delete account option in the APP. YUMMY will delete Google user data within thirty (30) days of the request.
YUMMY’s use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
If the USER signs in with other providers, such as Apple, YUMMY applies the same criteria to the data those providers share.
Location is essential to provide a mobility service: it lets us assign the nearest DRIVER, calculate the fare, plot the route, estimate arrival times and respond to emergencies.
Riders. YUMMY collects the precise location of the RIDER’s device while the APP is open, and during the trip even when the APP is in the background, from the request until shortly after the trip ends. The RIDER can deny or revoke location permission in their device settings; in that case they will need to enter their pickup point manually, and some features, such as fast matching or the emergency button with location, may be limited.
Drivers. YUMMY collects the precise location of the DRIVER’s device continuously while they are online and available to receive trips or on a trip, even when the APP is in the background or the screen is off. This collection is needed to assign requests, record the route and keep both parties safe. YUMMY does not collect the DRIVER’s location while they are offline.
During a trip, the DRIVER’s location is shown to the RIDER, and the RIDER’s pickup point is shown to the DRIVER. If the USER shares their trip, the people they choose can see the route in real time until the trip ends.
To protect RIDERS and DRIVERS against identity theft and fraudulent use of accounts, YUMMY may ask to capture photos or video of the USER’s face and compare them with the photo on their identity document or profile. For DRIVERS, this verification takes place at sign-up and periodically or at random before going online.
Biometric data is SENSITIVE DATA and its processing follows these rules:
Likewise, DRIVERS’ criminal record and medical certificates are treated as SENSITIVE DATA, are only viewed by authorized staff in the qualification process, and are used only to assess whether the applicant is fit to provide transportation services safely.
YUMMY offers safety tools that involve processing additional PERSONAL INFORMATION:
YUMMY processes PERSONAL INFORMATION for the following purposes:
YUMMY may use automated processes to assign trips, calculate dynamic fares and detect fraud. Where an automated decision may lead to the suspension or deactivation of an account, the USER may ask for it to be reviewed by a person and present their arguments.
YUMMY does not sell its USERS’ PERSONAL INFORMATION. We only share it in the following cases:
Some of our Processors, such as cloud hosting, maps or identity verification providers, may store or process PERSONAL INFORMATION on servers located outside Venezuela. In those cases, YUMMY contractually requires those providers to give a level of protection equivalent to the one described in this POLICY, including confidentiality, security and limited-use obligations. By accepting this POLICY, the USER consents to those transfers.
YUMMY keeps PERSONAL INFORMATION while the account is active and, after it is deleted, only for as long as needed to meet legal obligations, resolve disputes, prevent fraud and enforce its rights. As a reference:
Under Article 28 of the Constitution, the owner of the PERSONAL INFORMATION has the right, free of charge, to:
To exercise these rights, the data subject can write to info@yummysuperapp.com stating their name, the phone number or email linked to their account and the right they wish to exercise, or use the customer support channels in the APP. To protect the account, YUMMY may ask for additional information to verify the requester’s identity. YUMMY will reply within fifteen (15) business days of receiving a complete request.
This does not limit the data subject’s right to bring a habeas data action before the competent courts.
The SERVICES are not aimed at people under eighteen (18) years of age, who cannot create an account as a RIDER or as a DRIVER. A minor may only ride accompanied by an adult account holder, or in the cases YUMMY expressly enables, under the responsibility of their legal representative. If YUMMY finds that it has collected data from a minor without the corresponding authorization, it will delete it.
The WEBSITE and the APP use cookies, SDKs, pixels and similar technologies to keep the session active, remember preferences, measure use of the SERVICES, detect fraud and show advertising tailored to the USER’s interests on third-party platforms, as described in the Privacy and Security Policy of the Terms and Conditions. The USER can block or delete cookies in their browser settings, and reset or limit the advertising identifier in their device settings.
YUMMY applies reasonable technical and organizational measures to protect PERSONAL INFORMATION against loss, alteration, and unauthorized access or use, including: encryption of data in transit and, for SENSITIVE DATA, at rest; role-based access control with the least privilege needed; access logging; phone number masking; and confidentiality obligations for employees and Processors.
No system is completely infallible. If a security incident compromises PERSONAL INFORMATION and poses a risk to data subjects, YUMMY will take the necessary measures to contain it and will notify affected USERS without undue delay, stating the nature of the incident and the recommended measures. The USER is responsible for keeping their sign-in credentials confidential and for notifying YUMMY of any unauthorized use of their account.
YUMMY will send the USER the operational notifications needed to provide the SERVICES, such as trip status, receipts, safety alerts and changes to the account or to this POLICY; these communications cannot be turned off while the account is active.
Promotional communications, sent by push notification, email, SMS, WhatsApp or other channels, can be turned off at any time in the APP settings, through the unsubscribe link included in each email, or by writing to info@yummysuperapp.com. Unsubscribing from promotional communications does not affect the use of the SERVICES.
YUMMY may change this POLICY to reflect changes in the SERVICES, in the law or in its practices. Changes will be published on this page with their update date. Where the changes are substantial, especially if they expand the purposes or the processing of SENSITIVE DATA, YUMMY will notify USERS through the APP or by email before they take effect and, where the law requires it, will ask for new consent.
For any question, request or claim related to this POLICY or to the processing of their PERSONAL INFORMATION, the USER can contact YUMMY at info@yummysuperapp.com, through the customer support channels in the APP, or in the Help center.
